terms of service
These terms set out the agreement between you and nhale when you use our website, enrol in our course, book a session, or join our membership. Please read them carefully — by using nhale you agree to them.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law, where those rights cannot lawfully be excluded. Where there is any inconsistency, the Australian Consumer Law prevails.

Who we are
nhale is operated by nhale Pty Ltd(ABN 00 000 000 000), a company registered in Australia and based in Brisbane, Queensland. In these terms, “nhale”, “we”, “us”, and “our” mean nhale Pty Ltd.

Acceptance of these terms
By accessing our website, creating an account, purchasing the course, booking a 1:1 session, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these terms and by our Privacy Policy and Health & Safety Disclaimer. If you do not agree, please do not use our services.

Eligibility
Our services are intended for adults. You must be at least 18 years old to create an account, make a purchase, or book a session. By using nhale you confirm that you are 18 or older and able to enter into a binding agreement.

Your account & security
You are responsible for keeping your account details and password confidential, and for all activity that occurs under your account. Please notify us promptly at hello@nhale.com.au if you believe your account has been accessed without your permission. We may suspend access where we reasonably suspect unauthorised or unsafe use.

The digital course — your licence
Our flagship course is a one-time purchase of A$197 that grants you lifetime access to the course content for as long as we continue to operate it.
When you purchase the course we grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the course content for your own personal, non-commercial practice. You may not share, resell, sublicense, redistribute, broadcast, record, or otherwise make the content available to any other person, whether for payment or for free. The course is for one person — you.
“Lifetime access” means access for the operational lifetime of the course. It does not create an obligation on us to maintain the course indefinitely, but if we ever permanently retire it we will give reasonable notice and a fair way to download or retain materials where practicable.

Sessions & membership
We offer 1:1 sessions including breathwork sessions, Reiki sessions, and extended integration sessions, priced at A$120, A$120, and A$180 respectively. Prices for individual sessions are shown at the time of booking.
We may also offer a membership in the future. Membership terms, pricing, and billing cycles will be presented to you before you subscribe, and any recurring billing will be clearly disclosed at the point of sale.

Payments
Payments are processed securely by Stripe. We do not collect or store your full card number. All prices are in Australian dollars (AUD) and are inclusive of GST where GST applies. You authorise us, through Stripe, to charge the payment method you provide for the purchases you make.
If a payment fails or is reversed, we may suspend access to the relevant service until the amount owing is resolved.

Refunds & cancellations
The course.
We offer a 14-day refund on the course where you have consumed less than 20% of the course content, measured by your progress through the lessons. To request a refund, email hello@nhale.com.au within 14 days of purchase.
This refund offer sits on top of, and does not limit, your rights under the Australian Consumer Law. If the course is not of acceptable quality, does not match its description, or otherwise fails a consumer guarantee, you may be entitled to a remedy regardless of the 14-day window — these rights cannot be excluded.
Sessions.
We ask for at least 48 hours’ notice to cancel or reschedule a 1:1 session. Cancellations or reschedules made with less than 48 hours’ notice, and missed sessions, may incur a fee of up to the full session price, because the time has been reserved for you. We will always try to be reasonable where genuine emergencies arise.

1:1 session conduct
To get the most from a session, please arrive prepared: in a quiet space with a stable connection (for online sessions), having read our Health & Safety Disclaimer, and not under the influence of alcohol or recreational drugs.
If you are running late, we will do our best to accommodate you, but a session may end at its scheduled time so that we can honour the bookings that follow. If you do not attend within 15 minutes of the start time without notice, the session may be treated as a no-show.

Intellectual property
All content on nhale — including the course, audio, video, written materials, protocols, the breath timer, branding, and the website itself — is owned by or licensed to nhale Pty Ltd and is protected by intellectual property laws. Your licence to use it is limited to the rights expressly granted in these terms. You may not copy, modify, distribute, or create derivative works without our written permission.

Acceptable use
You agree not to:
- use nhale for any unlawful purpose or in breach of these terms;
- share, resell, or redistribute course content or session recordings;
- attempt to access accounts, data, or systems that are not yours;
- interfere with, disrupt, or place undue load on our services; or
- misrepresent your identity or your health information in a way that could put you or others at risk.

Health & safety acknowledgement
Breathwork and Reiki are educational and wellness practices. They are not medical treatment and are not a substitute for professional medical or mental-health care. Before using the breath timer, enrolling in the course, or booking a session, you must read and acknowledge our Health & Safety Disclaimer, including the contraindications and safety rules set out there. Your use of nhale confirms that you have done so.

Disclaimer of warranties
To the extent permitted by law, and subject always to the Australian Consumer Law, our services are provided “as is” and we make no warranties that they will be uninterrupted, error-free, or fit for a particular purpose beyond what the law requires. We do not warrant any specific health, wellbeing, or performance outcome from any practice. Nothing in this clause limits any consumer guarantee that cannot lawfully be excluded.

Limitation of liability
To the maximum extent permitted by law, and except for liability that cannot be excluded under the Australian Consumer Law, nhale Pty Ltd is not liable for any indirect, incidental, special, or consequential loss arising from your use of our services. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant service or refunding the amount you paid for it.

Termination
You may stop using nhale at any time. We may suspend or terminate your access if you breach these terms, if required by law, or to protect the safety of you or others. Where we end your access without cause, we will refund any portion of a prepaid service you have not yet received. Clauses that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — will continue to apply.

Changes to these terms
We may update these terms from time to time. When we do, we will revise the “last updated” date above, and for material changes we will take reasonable steps to let you know. Continuing to use nhale after a change means you accept the updated terms. We recommend you keep your own copy of the terms and your purchase records for your reference.

Governing law & disputes
These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland.
If something goes wrong, please contact us first at hello@nhale.com.au. We genuinely want to resolve concerns quickly and fairly. If we cannot resolve a dispute together, you retain all rights available to you under Australian law, including any external dispute-resolution options.
